Dava süreci mahkeme, kalem, avukat, hâkim ve tarafların işbirliğine dayalı bir organizasyon olarak karşımıza çıkmaktadır. Dava yönetimi ise kutsal bir amaç olan adaletin sağlanması amacının gerçekleşmesi için bir yol haritası işlevini görmektedir. Bu haritanın ne şekilde belirleneceği ise siyasi, sosyal ve ekonomik düşünceler sonucu şekillenen bir tercihe dayanmaktadır.
Bu çalışmamızda öncelikle farklı hukuk sistemlerindeki düzenlemeler incelenecek ve uygulamadaki dava yönetimine değinilecektir. Sonrasında davanın yönetilememesi sorunu ele alınacak ve sorunun çözümüne ilişkin önerilere yer verilecektir.
Process of litigation appears as an organization which is based on collaboration of the court, the Court pens, the lawyer, the judge, the plaintiff and the defendant. Litigation management is used as the road map for realizing the aim of ensuring justice. How to determine this map is shaped by political, social and economic considerations.
İn this study, firstly, different legal systems will be examined and the litigation management which is in practise will be mentioned. Then, the problem of why the litigation is not able to be managed will be discussed and the suggestions on the solution of the problem will be given.
